The National Information Technology Development Agency (the ”NITDA”) is statutorily mandated under o the National Information Technology Development Act (the “Act”) to collaborate with any local or state Government, company, firm, or person in any activity, which in the opinion of the agency is intended to facilitate the attainment of the objective of the Act.
The Federal Government of Nigeria had on 29 March 2020 announced a lockdown and restriction of movement of persons to stem the spread of the COVID-19 virus.
The objective of the Act is to plan, develop and promote the use of Information technology in Nigeria. The order however excluded the following:
- hospitals and all related medical establishments as well as organizations in health care related manufacturing and distribution;
- commercial establishments such as (i) food processing, distribution and retail companies; (ii) petroleum distribution and retail entities; (iii) power generation, transmission and distribution companies; and (iv) private security companies;
- workers in telecommunication companies, broadcasters, print and electronic media staff who can prove they are unable to work from home.
